In accordance with Cabinet Regulations No. 255 of May 20, 2014, “Regulations Regarding Distance Contracts,” AS “SISTĒMU INOVĀCIJAS”, Reg. No. 40003946311 (hereinafter – the Seller), provides potential customers (hereinafter – Consumers) with information regarding the terms and conditions for applying warranty rights and the right of withdrawal.
1. WARRANTY
1.1. To avoid misunderstandings, please inspect the delivered goods upon receipt to ensure they correspond to your order.
1.2. The main characteristics of the goods, as well as the expiration date and manufacturer, are indicated on the packaging. The Seller ensures that dietary supplements offered for sale are labeled and presented in accordance with the regulatory acts governing the use and labeling of medicinal products, and that information regarding the correct and safe use of the medicines is attached.
1.3. A warranty is a free promise by the manufacturer or seller to refund the consumer the amount paid for the goods, exchange the goods for suitable ones, rectify the non-compliance of the goods free of charge, or perform other actions if the goods do not conform to the characteristics provided in the warranty.
1.4. Warranty rights shall be exercised in accordance with the regulatory acts in force in the Republic of Latvia, taking into account the type of goods sold, their specific properties, and specific storage requirements (humidity, light, temperature limitations, etc.).
1.5. Warranty rights can be exercised only if the Buyer has retained proof of purchase, which must be submitted to the Seller along with the purchased item.
1.6. The Consumer is entitled to submit a claim throughout the entire warranty period in accordance with the conditions specified in the warranty document (found in the product packaging). The Consumer’s claim will be processed according to the conditions stated in the warranty document.
1.7. The Consumer is entitled to submit a claim to the Seller regarding non-compliance of the Goods with the contract terms within 2 years from the date of purchase. Such a claim must be submitted to the Seller within 14 days from the date the Buyer discovered the non-compliance. The date of purchase is considered the date on which the Seller handed over and the Buyer accepted the respective Goods.
1.8. The Seller reserves the right to provide the manufacturer’s contact details so that the client can resolve warranty issues directly with the manufacturer, without the Seller’s involvement.
2. RIGHT OF WITHDRAWAL
2.1. To exercise the Right of Withdrawal, the Goods must be unused, undamaged, and in their original appearance (with unremoved and undamaged labels, intact protective films, etc.).
2.2. The Consumer may exercise the right of withdrawal within 14 days and withdraw from the distance contract without giving any reason (except in cases involving purchased food supplements, non-prescription medications, and medical products that require specific storage conditions—such as humidity, light, and temperature limitations—pursuant to Cabinet Regulations No. 416 of June 26, 2007, “Procedures for the Distribution and Quality Control of Medicines”).
2.3. Before the expiration of the right of withdrawal period, the Consumer shall inform the Seller of the decision to withdraw from the contract by sending a withdrawal form or a notice on the exercise of the right of withdrawal to office@sibiotech.com. The deadline is met if the consumer sends the withdrawal form or notice before the period expires. The burden of proof for exercising the right of withdrawal rests with the Consumer.
2.4. The Consumer shall return or hand over the goods to the seller or an authorized representative without undue delay, but no later than 14 days after sending the withdrawal form or notice to the seller. The deadline is met if the goods are sent back before the 14-day period expires. This requirement does not apply if the seller has offered to collect the goods themselves.
2.5. The Seller shall refund all payments received from the consumer, including delivery costs, without undue delay and no later than 14 days from the day on which they were informed of the consumer’s decision to withdraw from the contract. The Seller or service provider shall perform the refund using the same payment method as used by the consumer, unless the consumer has expressly agreed to a different payment method and provided that the consumer does not incur any fees as a result of such refund.
2.6. If the Consumer has expressly chosen a delivery method other than the cheapest standard delivery option offered by the seller, the seller is not obligated to refund the additional delivery costs.
2.7. The Seller is entitled to withhold the refund under the purchase contract until they have received the goods back or until the consumer has supplied proof of having sent back the goods, whichever is earlier. This right does not apply if the seller has offered to collect the goods themselves.
2.8. The Consumer cannot exercise the right of withdrawal if:
2.8.1. the goods are made to the consumer’s specifications or are clearly personalized;
2.8.2. the goods are liable to deteriorate or expire rapidly;
2.8.3. the consumer has opened the packaging of goods that cannot be returned due to health or hygiene reasons;
2.8.4. the goods, due to their nature, are inseparably mixed with other items after delivery;
2.8.5. purchased Goods are perishable or rapidly consumed (hygiene products, cosmetics);
2.8.6. purchased food supplements, non-prescription medicines, and medical products require specific storage conditions (humidity, light, temperature limitations, etc.) pursuant to Cabinet Regulations No. 416 of June 26, 2007, “Procedures for the Distribution and Quality Control of Medicines”;
2.8.7. the goods are damaged.
2.9. Product images on https://sibiotech.com/ are for illustrative purposes only. Photos of Goods or Goods packaging may differ from the actual size and appearance of the Goods or packaging.
2.10. Order fulfillment — upon receiving the Order and payment, the Seller processes and packs the Order. If the Seller finds that any of the Goods specified in the Buyer’s Order are entirely unavailable or unavailable in the requested quantity, the Seller will pack the Order according to available items, notify the Buyer of the adjustments via email, and refund the money paid for the unavailable items to the Buyer’s account.
3. AS “SISTĒMU INOVĀCIJAS” reserves the right to unilaterally modify the terms of promotional campaigns or terminate promotions without prior notice.
